Airtech International Notice and Privacy Policy for California Applicants and Employees

Please take notice that Airtech International (the Company) collects certain personal information about you. This Privacy Policy describes the categories of personal information the Company collects and the purposes for which it is used in accordance with the California’s California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA). The details below apply to personal and sensitive personal information currently collected as well as the 12-month period prior to the date this Privacy Notice was last updated.

This Privacy Policy applies to the personal information of California applicants, employees, independent contractors, and other individuals who perform work for the Company, (all collectively, HR Individuals) and includes employee dependents and emergency contacts.

The law provides California HR Individuals with certain rights with respect to the personal information collected from them, including the rights:

  • To delete personal information.
  • To correct inaccurate personal information.
  • To access personal information.
  • To know what personal information is sold or shared and to whom.
  • To opt out of the selling or sharing of your personal information.
  • To limit use and disclosure of sensitive personal information.
  • Not to be discriminated against or retaliated against for exercising rights under the law.

The personal and sensitive personal information that we are collecting.

We are collecting the following information:

  • Identifiers, such as name, government-issued identifier (e.g., Social Security number (SSN)) and unique identifiers (e.g., employee ID).
  • Personal information, such as real name, signature, SSN, physical characteristics or description, address, telephone number, passport number, driver’s license or state identification card number, federal identification authorizing work in the United States, access and/or passcodes, insurance policy number, education, employment, employment history, bank account number, other financial information, medical information or health insurance information.
  • Characteristics of protected classifications under California or federal law, such as age, marital status, gender, sex, race, color, disability, citizenship, primary language, immigration status, military/veteran status, disability, request for leave and medical conditions
  • Commercial information, such as transaction information and purchase history (e.g., in connection with expense reimbursements).
  • Internet or network activity information, such as browsing history and interactions with our online systems and websites and any personal information that you provide while accessing the Company’s computer systems, such as personal credit card information and passwords
  • Geolocation data, such as device location from using the Company’s devices.
  • Biometric information, such as fingerprints required to connect to the Company’s secured access points and timeclocks.
  • Audio, electronic, visual, and similar information, such as voicemail recordings, footage from video surveillance, and badge photos.
  • Professional or employment-related information, such as work history, prior employers, data submitted in job applications, professional licenses, degrees, background checks, performance and disciplinary records, compensation, benefits and leaves of absence information.
  • Non-public educational information, such as academic transcripts.
  • Inferences about you that help us better understand your preference, skills, abilities, or aptitudes. We do not, process any categories of sensitive personal information (as defined by applicable law) for purposes of inferring characteristic about you.

Where we get your information from.

The Company collects information about you from the following sources:

  • You.
  • Prior employers, references, recruiters and job-related social media platforms.
  • Third-party companies, such as background check companies, occupational health clinics, staffing agencies, licensing and credentialing organizations; and
  • Claim administrators and investigators.

Depending on the Company’s interactions with you, we may or may not collect all the information identified about you.

How your personal and sensitive personal information is used.

We may use personal and sensitive personal information for the following purposes:

  • Recruiting and retaining employees.
  • Collecting and processing employment applications, including confirming eligibility for employment, background and related checks, and onboarding.
  • Employee benefit plan and program administration.
  • Leave of absence administration.
  • Compensation administration and compliance, including payroll, bonuses, reimbursements, etc.
  • Maintaining personnel records and complying with record retention requirements.
  • Communicating with employees and/or employees’ emergency contacts and benefit plan dependents/beneficiaries.
  • Facilitating and administering the use of the company’s property and resources, including the company’s information systems, electronic devices, network and data, and preventing unauthorized access of such.
  • Workplace health and safety compliance.
  • Ensuring employee productivity and adherence to the policies.
  • Investigating complaints, grievances, and suspected violations of policy.
  • Complying with applicable state and federal laws, including labor, employment, tax, benefits, workers compensation, disability, equal employment opportunity, workplace safety and related laws.
  • Exercising and defending legal claims.

We may or may not have used personal and sensitive personal information about you for each of the above purposes.

Selling or sharing personal information

For purposes of the CCPA/CPRA, the Company does not sell or share the personal information or sensitive personal information of HR Individuals.

We may disclose personal information for a business purpose to service providers who assist us in administering our workforce such as, benefits providers, payroll administrators, workers’ compensation vendors, professional advisors such as attorneys and auditors, and government agencies

We do not process sensitive personal information for purposes other than the purpose for which it was originally collected.

Your privacy rights and choices.

The CCPA/CRPA provides employees/applicants with specific rights regarding their personal information. This section describes your CCPA/CPRA rights and explains how to exercise those rights.

  • Right to know. You have the right to submit a verifiable request for copies of specific pieces of your personal information collected in the preceding 12 months. You may make these requests up to twice in a 12-month period. Certain information will not be released to you because of legal restrictions or because the information is used for security purposes. We will acknowledge receipt of your request within 10 business days and provide a copy of your information in an easily readable format within 45 days.
  • Right to correct. You have the right to submit a verifiable request for correction of inaccurate personal information maintained by the Company. We will acknowledge receipt of your request within 10 business days, and we will correct your information promptly (and at least within 45 days) after verifying your request.
  • Right to delete. You have the right to submit a verifiable request for the deletion of personal information that you have provided to the Company. We are not permitted to delete information that we need to operate our business, administer our employees, protect our legal obligations and rights, or to provide security for our employees, our systems and our company. You may make this request up to twice in a calendar year. We will acknowledge receipt of your request within 10 business days and honor your request within 45 days.
  • Right to opt out of sale and sharing. For purposes of the CCPA/CPRA, the Company does not sell or share the personal information or sensitive personal information of job applicants and employees.
  • Right to limit processing of sensitive personal information.

Data retention

We retain all categories of personal information for as long as is necessary in relation to your employment with the Company, our administration of benefits or as long as we need to meet our legal obligations or business requirements.

Verifying Requests

To help protect your privacy and maintain security, we will take steps to verify your identity before granting you access to your personal information or complying with your request. Based on the HR Covered Individual request, you will be required to submit specific pieces of information. The Company will use this information to search our systems and determine if we have information about you. If we can locate information about you, we will fulfill your request as required by law.

Authorized Agent

If you are an authorized agent, you will be required to submit your information as well as specific pieces of information about the individual for whom you are making a request. You will also be asked to fill out a certification form confirming your information and certifying you have the right to make this request on behalf of the individual.

Non-discrimination/non-retaliation

The Company will not unlawfully discriminate or retaliate against you for exercising your rights under the California Privacy Rights Act.

Updates

We may update or make changes to this Policy from time to time and may apply any changes to information previously collected, as permitted by law. When we make material changes to this Policy, we will notify you by posting the updated Policy and update the last updated date at the end of this Policy.
